Welcome to AudioVerse! These Terms and Conditions govern your use of the AudioVerse website and platform (the "Service") provided by Verse Media Corp, located at 123 Innovation Drive, Techville, CA 91234. By accessing or using the Service, you agree to be bound by these Terms and Conditions. If you disagree with any part of the terms, then you may not access the Service.

AudioVerse provides a platform for users to discover, listen to, and share podcasts. The Service includes a website, mobile applications, and related services. Verse Media Corp reserves the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.

To access certain features of the Service, you may be required to create an account. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account. You must be at least 13 years old to create an account. If you are under 18, you must have parental consent.

VERSE MEDIA CORP DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, VERSE MEDIA CORP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

IN NO EVENT SHALL VERSE MEDIA CORP'S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED ONE HUNDRED U.S. DOLLARS (US$100.00).

You agree to indemnify and hold Verse Media Corp, its affiliates, officers, agents, and employees harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Service, your User Content, your violation of these Terms and Conditions, or your violation of any rights of another.

Any dispute arising out of or relating to these Terms and Conditions or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in Techville, California. The decision of the arbitrator shall be final and binding on the parties. You and Verse Media Corp each waive the right to a jury trial.

Alternatively, at Verse Media Corp’s sole discretion, disputes can be resolved through small claims court, where the amount in controversy does not exceed the jurisdictional limit of the small claims court.

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

13. Changes to Terms and Conditions

Verse Media Corp reserves the right to modify or update these Terms and Conditions at any time without prior notice. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms and Conditions. It is your responsibility to review these Terms and Conditions periodically for changes.

14. Termination

Verse Media Corp may terminate your access to the Service, without cause or notice, which may result in the forfeiture and destruction of all information associated with your account. All provisions of these Terms and Conditions that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
